By accessing or using the Meal Journaling platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service. These terms apply to all users, including nutrition coaches ("Coaches") and their patients ("Patients").

2. Description of Service

Meal Journaling provides a platform for nutrition professionals to manage patient check-ins via SMS. The Service includes automated AI-powered text messaging, check-in analysis, adherence scoring, and progress tracking tools. Meal Journaling is a coaching support tool and does not provide medical advice, diagnosis, or treatment.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to create an account.
  • Coaches are responsible for obtaining appropriate consent from patients before adding them to the platform and enrolling them in SMS messaging.

4. SMS Messaging Terms

By participating in Meal Journaling SMS messaging:

  • Patients consent to receive automated text messages at the phone number provided by their Coach.
  • Message frequency varies based on the check-in schedule (e.g., daily or weekly).
  • Message and data rates may apply depending on your mobile carrier plan.
  • Patients may opt out at any time by replying STOP to any message.
  • For assistance, reply HELP or contact support@nutricoach.app.
  • SMS messaging is available for US and Canadian phone numbers.

5. AI-Generated Content

Meal Journaling uses artificial intelligence to generate check-in prompts, analyze patient responses, and provide coaching replies. While we strive for accuracy and helpfulness, AI-generated content is not a substitute for professional medical or nutritional advice. Coaches should review AI-generated insights and exercise their professional judgment. Patients should consult their healthcare provider for medical decisions.

6. Coach Responsibilities

As a Coach using Meal Journaling, you agree to:

  • Only add patients who have given you consent to enroll them in SMS-based coaching.
  • Provide accurate patient information including correct phone numbers.
  • Monitor AI-generated communications and intervene when professional judgment requires it.
  • Comply with all applicable laws, regulations, and professional standards related to nutrition counseling.
  • Not use the platform for any purpose that is unlawful or prohibited by these Terms.

7. Patient Responsibilities

As a Patient using Meal Journaling, you agree to:

  • Provide honest and accurate information in your check-ins.
  • Understand that AI-generated responses are for coaching support only and are not medical advice.
  • Consult your healthcare provider for any medical concerns or before making significant changes to your diet or medication.

8. Intellectual Property

The Meal Journaling platform, including its design, features, and content, is owned by Meal Journaling and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without written permission.

9. Limitation of Liability

Meal Journaling is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Meal Journaling shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Meal Journaling is not responsible for health outcomes resulting from coaching recommendations or AI-generated content.

10. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
